随着人类社会的不断进步发展和社会主义法制制度的逐步建立及完善，社会对个人的要求越来越高，法也越来越受到人们的重视，依法办事，已成为人们的共同信念。一个国家的法律体制完善与否也日益成为衡量这个国家现代化程度高低的标志。然而，根据有关数据表明：近几年来我国大学生的违法犯罪率呈大幅度增长趋势，可见增强法律意识、提高法制观念对大学生来说有着极其重要的作用。为了提高大学生的法律意识，我通过对调查问卷进行归类分析，对当前大学生对法律的认识情况有了初步的了解，同时对如何提高大学生的法律意识有了一定的计策。我还通过直访大学生，更加直接、清楚地了解到大学生的心里话，从而更加深入了解到当前大学生法律意识的情况。

一、调查问卷分析大学生法律意识存在的问题

对新疆各大院校学生进行了法律意识问卷调查，发放问卷80份，收回68份。男女比列1:1。

（一）大学生的法律知识水*有待提高。

法律知识是法律意识的一个重要内容，是衡量法律意识水*高低的一个重要标准。*政法大学研究生院董舆教授通过他的法律意识调查报告显示出：“人们的法律意识水*的高低与其文化程度成正比。”大学生的法律知识水*普遍不高。当前我国大学生大都重视专业课，而对法律基础课不予以重视。另一方面，高校的《法律基础》课学时有限，要想在这么短的时间内要想大幅度的提高大学生的法律知识水*是很困难的。因此，高校大学生在这有限的课时中获得的法律知识也是有限的。

（二）大学生法律意识欠缺、法制观念淡薄。

法律意识是指人们关于法和法律现象的思想、观点和心里的总和。法制观点是高层次的法律意识，是人们对于现存的法律规范、法律活动和法律关系等现象的概括和总和。法律意识，法制观念决定着大学生，甚至是以后走入社会依法办事的自觉性。当前，非法律专业大学生法律知识匮乏，就容易产生错误的法律判断意识、淡薄的法制观念。在这种错误意识和观念支配下的大学生，违法犯罪行为无法预料。

（三）法律权利意识弱于法律实用意识

权利和义务是整个法律体系的核心内容，任何法律都不在乎是主体权利和义务的规定。法律观念和法制观念的强弱主要取决于主体的权利观念的强弱，权利意识对大学生法制观念的培养尤为重要。权利意识既包括对自我权利的认识、要求，也包括对他人权利的必然和必要性。没有对他人权利的尊重，就没有现代意义的权利观念。改革开放以来，随着经济发展和法制建设的进行，大学生越来越关注一些法律现象，在事关社会问题的解决尤其是身边的涉法问题时，他们能首先想到应该运用法律。但是，当他们自身遇到问题时，却因缺乏权利意识而极力回避，既缺乏对自己权利的维护，又缺乏对他人权利的尊重。主要表现在：一方面，当自己的合法权益受到侵害时，不能积极主动地利用法律武器维护自己的正当权益，而是以消极的态度对待法律，甚至会放弃法律武器，采用报复的手段来讨回“公道”。另一方面，在事关自己的利益时，比如说在评优评奖、入党、就业、担任干部等具体切身利益面前，却一马当先，采取尽可能的手段，逃规避法为自己谋利，有时甚至导致违法犯罪行为的发生；在一方面，当自己的行为侵犯了他人的权益时，比如晚上熄灯后大声喧哗，影响他人休息，不经允许随意拿别人的东西，考试作弊等，完全不顾及他人的权利，甚至极力逃避，推卸责任，企望能法外开恩、法理容情，缺乏承担法律责任的意识的勇气。

（四）法律意识层面有待提高

法律知识是法律意识的一个主要内容，是衡量法律意识高低的主要依据。掌握法律知识的多少，法律水*的高低与法律意识成正比，随着我国法制的不断健全，内容的不断丰富，大学生整体的法律知识水*也应随之提高。但是目前，我国高校学生的法律知识水*并不理想。高校学生大多重视专业课而忽视基础课，因而多数学生对基础课只有到了考试的时候才临时抱佛脚应付了事，在这种思想支配下，大学生就不可能把法律基础课上好，就不会有扎实的法律基础知识。同时，除了法学院校外，不少高校法律基础课课时过少，教师只能略教一些法律知识，大学生也只不过略懂一些法律概念和常识。由于当前大学生法律基础知识比较薄弱，法律知识水*不高，因此，造成了他们一些错误的法律观点、淡薄的法制观念。错误的法律观点主要表现在：一是权与法不分、有不少学生认为在当今*，权大于法；二是违法与犯罪界限不清，把二者等同起来；三是道德与法的界限不清，把道德规范作为法律规范，把道德情感当作法律准则，认为不符合道德规范的就是违法，淡薄的法制观念主要表现在：当自己的合法利益受到侵害时，不知道用法律手段类似保护自己。或者不相信法律，放弃法律武器。

（五）大学生的法律理论知识与实践相脱节

在我国任何一所高校都开设法律基础课作为非法律专业学生的选修课，在法律基础课上通过老师的讲授能够学到一定的法律知识，学生们都知道遇到问题、纠纷应该采取法律措施，拿起法律的武器来捍卫自己的权利。但是在现实中，如同学之间发生矛盾冲突时，有的同学就不能采取正确的方法解决，往往是头脑一热，就采取一些过激的，甚至愚昧的方式，最终造成严重的后果；有的同学则是当自己的合法权益受到侵害时，却不懂得如何用法律保护自己。因此，提高大学生运用法律知识的实践能力，使其学以致用，是迫在眉睫的一件大事。

二、调查中我们了解到大学生犯罪率高的客观原因有以下三个

（一）有的家长教育方法不好，有些是对孩子无原则的溺爱、袒护和娇纵，致使孩子对自己的不良行为产生“合理感”；有些是孩子出现问题后采用极端粗暴方式管教，无情的谩骂，甚至赶出家门。另外有的家长有不良嗜好的也有可能对孩子的成长产生不利影响。

（二）学校教育存在偏差。

主要表现在：一是重视学生的智育教育，对学生的品行教育重视不够。为了应付考试，有压缩、挤占其它非考试科目课的现象发生。虽然学校有教给学生一定的法律知识，但却只局限与课本或书面上，未能真正教会学生运用法律，导致学生只会口头上的法律知识。

（三）、社会诱因的侵蚀。

近几年来，社会上不良风气对大学生有很大的腐蚀作用，*门有时对文化市场管理不够严格。另外，当前社会很多市民的法律意识淡薄，在这种社会环境潜移默化的影响下，造成大学生对法律的不重视，导致有些大学生由于存在侥幸心里而走上的犯罪的道路。

三、大学生犯罪率高的主观原因有以下三个

（一）有的大学生法律观念淡薄，不学法、不懂法，往往从一些影视作品、电脑游戏、书刊杂志中，吸收一些不健康的东西，加上他们有的认识问题的能力和辨别是非的能力差，看问题简单、片面，待人处事往往感情用事，很少经过深思熟虑，常常不计后果。

（二）有的大学生性格内向、孤僻，加上来自学校、家长、社会等方面的压力大，心理长期受压抑，缺乏倾诉对象，*时又得不到正确的引导，成为违法犯罪的心理动因。再加上易冲动，不能克制自己的情绪，以致造成明知故犯的`严重后果。

（三）有的大学生虽然对法律知识有一定的了解，但在现实生活中，受他们所处的环境和背景影响，往往会因为克制不住私欲而忽视了法律做出违法的事情。

由此可见影响大学生法律意识的因素有很多。根据调查显示，有的大学生认为家庭对他们法律意识的影响较大。他们觉得父母是孩子的是社会主义现代化事业的建设者和接班人。现代社会是一个法制社会，作为一名大学生要学习法律知识，学法才能知法，知法才能守法，知法才能用法，知法才能护法，只有全体人民的法制意识加强了，才能实行依法治国，我们的国家才能不断强大。然而，目前我国一部分大学生的法律知识水*还比较低，未能适应社会发展的需要。有些大学生虽然认识法律知识，但在现实生活中却未能将其合理运用，这也是当前大学生在法律层面上的一大弊病。
